In Alabama, resisting arrest is considered a serious crime. Under AL Code § 13A-3-28 (2023) and Alabama Code Section 13A-10-41, it is illegal for a person to intentionally prevent or attempt to prevent a law enforcement officer from effecting a lawful arrest of him/her or of another person. This can include using or threatening to use physical force against the law enforcement officer, or using any other means which creates a substantial risk of causing physical injury to the public servant or another.

Resisting arrest in Alabama is generally classified as a Class B misdemeanor. This can be punishable by up to six months in jail and a fine up to $3,000. However, the penalties can increase if the person resisting arrest causes physical injury to the officer or if they use a deadly weapon to resist arrest. In such cases, it can be classified as a Class A misdemeanor or a felony, attracting greater penalties.
